Jakarta, CNN Indonesia – The government will implement a tax amnesty program on January 1, 2022. With this program, taxpayers can disclose their net assets that have not been or are not disclosed in a statement letter to the state.
This policy is contained UU on the Harmonization of Tax Regulations (HPP).
Citing the document that have been circulating in the public, Monday (4/10), the tax amnesty program is written in Chapter V with the title ‘Voluntary Disclosure Program for Taxpayers’.
Every taxpayer can disclose their net assets that have not been or are not disclosed in the statement letter as long as the director general of tax has not found data or information regarding the assets in question.
The net assets in question are the value of assets minus the value of debt. This is as stated in Law Number 11 of 2016 concerning Tax Amnesty.
The reported assets are the assets obtained by taxpayers from January 1, 1985 to December 31, 2015. Later, the net assets will be considered as additional income and subject to final income tax (PPh).
Final PPh will be calculated by multiplying the rate by the tax base. The tariff consists of 6 percent of net assets that are in the country and are invested in business activities in the natural resource processing sector (SDA) or the new renewable energy sector (EBT), as well as state securities (SBN).
Then, 8 percent of net assets that are in the country and are not invested in the SDA, EBT, and SBN sectors. Furthermore, 6 percent of net assets are located outside Indonesia with the proviso that it will be transferred to the territory of Indonesia and invested in the SDA, EBT, and SBN sectors.
Meanwhile, 8 percent of net assets located outside Indonesia provided that they were transferred to Indonesia, but not invested in the SDA, EBT, and SBN sectors. Then, 11 percent of net assets that are outside Indonesia and are not transferred to Indonesia.
Meanwhile, the value of the property that is used as a guide to calculate the amount of the price is determined based on several things.
The details are the nominal value for the price in the form of cash or cash equivalents, the value determined by the government, the value published by PT Aneka Tambang Tbk for gold and silver, the value published by the PT Bursa Efek Indonesia for shares and warrants, and the value published by PT Penilai Indonesian Securities Price for SBN.
Every taxpayer can disclose net assets through a price disclosure notification letter. The letter was given to the director general of tax on January 1, 2022 to June 30, 2022.
In addition, taxpayers must also attach several documents, such as proof of final income tax payment, a detailed list of assets along with information on reported property ownership, a list of debts, a statement of transferring net assets to Indonesia, a statement of investing net assets in the SDA, EBT, and SBN business sectors. After that, the Director General of Taxes will issue a certificate against the submission of a notification letter on the disclosure of assets by the taxpayer.
